WHO Double Standard Condemned
The Coalition of Asia Pacific Tobacco Harm Reduction Advocates (CAPHRA) has condemned the World Health Organisation (WHO) for dismissing scrutiny of its funding as “misinformation” while enabling billionaire philanthropies to disproportionately influence global tobacco policy.
Disposable Ban Survey
Vape company Haypp is reminding the public about the unintended consequences that may arise from the upcoming ban on disposable/single-use vapes. With close to half of UK vapers using disposables, the upcoming ban is expected to impact a large number of users, the retailer says.
EU To Target Pouch Tax
Haypp Group’s Mark O’Mahoney has contacted Planet of the Vapes about a leaked European Union document proposing a major tax increase on nicotine pouches across the EU states. He tells us it shows how some states are pushing their agenda on pouches and perhaps indicates a broader direction of travel.
CoEHAR publishes the world’s first study assessing the impact of modified-risk products on eye health

Toxic compounds released by cigarette smoke are linked to inflammation and oxidative stress in the eye, both of which are risk factors for more severe ocular diseases. But what happens to smokers who switch to modified-risk products? An international team of researchers, led by CoEHAR in Catania, has conducted the world’s first study analyzing the effects of modified-risk tobacco products on the human cornea using a clinically relevant research model. The results highlighted significant differences in inflammatory response and oxidative stress levels.

Taxation has long been regarded as one of the most effective tools by traditional tobacco control groups for controlling tobacco consumption.[1] Tax on tobacco products is intended to serve two main purposes: to decrease demand by increasing prices, making these products less affordable and less appealing, and to generate government revenue.[2] Critics, however, suggest that tax is a blunt instrument, contributing to the economic inequalities faced by people who smoke and driving illicit markets.

On April 1, Dr. Brian King, the controversial director of the Food and Drug Administration’s Center for Tobacco Products (CTP), whose responsibilities included overseeing the authorization or rejection of vaping products for sale in the United States, emailed his staff.“It is with a heavy heart and profound disappointment that I share I have been placed on administrative leave,” he wrote. According to the Associated Press, King was offered reassignment to the Indian Health Service.

Then today, the U.S. Supreme Court declined to hear FDA v. Wages and White Lion, extinguishing immediate hopes for judicial relief from the FDA’s broken PMTA process.

The long-overdue shake-up at the Food and Drug Administration (FDA) has finally arrived. The FDA’s Center for Tobacco Products (CTP) Director Brian King has been placed on administrative leave, and dozens of employees at the FDA’s CTP have been dismissed, including two entire offices responsible for drafting new tobacco regulations. While this marks the welcome end of one of the most dysfunctional agencies in U.S. government history, the question remains as to what happens next.
Supreme Court Vacates Fifth Circuit Triton Decision

Yesterday, the Supreme Court vacated the Fifth Circuit Court ruling in favor of Triton Distribution and Vapetasia, sending the case back to the Fifth Circuit. The court’s 9-0 ruling is a win for the FDA, which appealed the Fifth Circuit decision to the high court, but it could be a temporary victory, because the court ruled narrowly and left many big questions unanswered.

The U.S. Supreme Court on Wednesday largely backed the U.S. Food and Drug Administration’s refusal to let two e-cigarette companies sell flavored vape products that regulators consider a health risk to youths. The justices threw out a lower court’s decision that the FDA had failed to follow proper legal procedures under a federal law called the Administrative Procedure Act when it rejected the applications by the companies, Triton Distribution and Vapetasia, to sell these nicotine-containing products.
The Supreme Court Blesses the FDA’s Rejection of Flavored Nicotine Vapes

In a unanimous decision on Wednesday, the Supreme Court rejected an appeals court’s conclusion that the Food and Drug Administration (FDA) violated the Administrative Procedure Act by “arbitrarily and capriciously” refusing to allow continued sales of flavored nicotine solutions produced by Vapetasia and Triton Distribution. The decision effectively approves the FDA’s de facto ban on nicotine vaping products in flavors other than tobacco and menthol, meaning that unfair and irrational policy will continue unless it is reversed by the Trump administration.
Consumer groups push harm reduction, real-world evidence in tobacco control

Spain has made “no progress in the fight against smoking” and should switch to Sweden’s more effective approach, a leading psychologist has warned. Karl Fagerström, clinical psychologist and creator of the widely-used nicotine dependence test, said Spain’s current prohibitive strategy is likely to “keep the number of smokers high.”Fagerström made the comments in response to Spain’s plans to ban disposable vapes and all flavours except tobacco and menthol, as well as nicotine pouches.
Poland to ban disposable vapes
Poland is drafting a new law to ban the sale of disposable vapes, regardless of whether they contain nicotine.
The Polish Ministry of Health said it plans to outlaw all single-use vapes in a bid to prevent young people from taking up vaping.
The legislative agenda states (translated from Polish): “The proposed regulations have the most impact on young people. E-cigarettes, whether they contain nicotine or other substances, are products that pose a clear threat to public health.
