New legislation came into force in England and Wales on 1 October 2015, introducing a minimum age of sale of 18 for e-cigarettes and prohibiting the purchase of these products on behalf of someone under the age of 18.

Fighting Evil or Protecting Health? Another Anti-Vaping Law goes up in Smoke

On May 3rd, the Quebec Superior Court struck down key sections of Quebec’s anti-vaping law that sought to treat vaping products essentially the same as cigarettes. The decision recognizes vaping as a form of harm reduction as it allows people who would otherwise smoke lethal cigarettes to get the nicotine they need or want without the inhalation of smoke. As the harm from cigarette use is overwhelmingly due to the inhalation of smoke rather than the nicotine, the decision underscores important lessons for harm reduction.
Vaping Hospitalizations Likely Linked to Black Markets

In August 2019, public health officials in several states reported an increase in young people being hospitalized due to lung illnesses believed to be caused by vaping. Health departments in Illinois, Minnesota, New Jersey, New York, North Carolina, Texas, and Wisconsin have issued health warnings against e-cigarette. Indeed, the Wisconsin Department of Health Services is urging “Wisconsinites to avoid vaping and e-cigarettes.”[i] CNN reported more than 120 cases in 15 states.[ii]

Patrick DeGrave’s brother was still in a medically induced coma in a Wisconsin hospital when he spoke to the local news. Standing before a crew from FOX 6 Milwaukee, he was ready to go public, and the vaporizer cartridge he held up for the cameras was the reason for his brother’s significant heart and lung damage.
The story that aired was also reported on by the Milwaukee Journal Sentinel and the national Fox News website, amongst others. In each story, a black box with a candy-colored logo appeared: Dank Vapes.
Vaping May Be Driving Down Smoking, Says Federal Survey Report

New survey data indicate that cigarette consumption among teenagers, young adults, and the general population continues to decline, notwithstanding fears that vaping would become a gateway to smoking. To the contrary, says a report on the 2018 National Survey on Drug Use and Health, e-cigarettes may be contributing to the downward trend in smoking.

Conversely, it’s harmful and immoral to spread misinformation that negatively affects public perception of life-saving products and discourages their use. I wanted to call attention to a new essay about bans by Marewa Glover, probably the most thoughtful and clear-reasoning person who still self-identifies as a tobacco controller. The piece is entitled “Do We Really Need Another Law? The cost to New Zealand of banning smoking in cars,” which describes its titular focus and the motivating policy proposal. But it is more a wide-ranging examination various implications of bans and tobacco control more generally. It is a long read at 16K words (which she calls a book, even though I would call it two long blog posts :-), but easy going and worth the time.

The most recent survey in a series that began in the 1980s indicates just 16% of the pupils have ever smoked tobacco, down from 19% in 2016 and 49% in 1996.
However, a quarter of the 13,000 pupils surveyed, from 193 schools across England, have tried drugs.
This includes nitrous oxide, known as laughing gas, as well as cannabis.

VTA Sues US Government
The Vapor Technology Association (VTA) filed a lawsuit against the Food and Drug Administration (FDA) over its Pre-Market Tobacco Application (PMTA) accelerated filing deadline. The deadline had been moved to 2021 but acting Commissioner Ned Sharpless said companies didn’t need that time in which to act and accelerated the deadline to May 2020.
BREAKING: JUUL Attacks VTA Lawsuit
On Monday, POTV announced how The Vapor Technology Association (VTA) filed a lawsuit against the Food and Drug Administration over its Pre-Market Tobacco Application accelerated filing deadline. JUUL Labs has announced its opposition to the lawsuit and its intention to leave the VTA.
